1. Acceptance of Terms

By accessing or using Musicologia ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Musicologia is a non-commercial, personal music exploration and commentary platform. It is operated as a passion project — not a business — and generates no revenue of any kind. There are no advertisements, subscriptions, paywalls, or monetization mechanisms.

The Service provides curated track information, AI-generated and human-written artist lore and commentary, lyric display, audio feature analysis, and embedded music previews. All of this is offered solely for purposes of personal enjoyment, music criticism, commentary, education, and scholarship.

3. User Accounts

You may sign in using third-party authentication providers (Spotify, GitHub). You are responsible for maintaining the security of your account credentials with those providers. You agree to provide accurate information and to not impersonate others.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its systems.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Scrape, crawl, or use automated tools to extract data from the Service without permission.
  • Reproduce, distribute, or create derivative works from any content provided through the Service without authorization.

5. Intellectual Property & Copyright

All music recordings, album artwork, lyrics, and related metadata displayed through the Service are the property of their respective rights holders (artists, labels, publishers, and songwriters). Musicologia does not claim ownership of any third-party content.

AI-generated lore, narrative commentary, and editorial content are original transformative works created for criticism, commentary, and educational purposes, and may not represent factual or biographical information.

6. Fair Use Notice

Musicologia incorporates limited portions of copyrighted material — including album artwork, song lyrics, and short audio previews — under the fair use doctrine as codified in 17 U.S.C. § 107. We believe our use qualifies as fair use based on the following analysis of the four statutory factors:

  • Purpose and character of the use: Musicologia is a non-commercial, personal project that generates no revenue. All third-party content is presented alongside original AI-generated commentary, audio analysis, and editorial context — making the use fundamentally transformative. The purpose is criticism, commentary, education, and personal scholarship, not reproduction or distribution of the original works.
  • Nature of the copyrighted works: The copyrighted materials used (music, lyrics, artwork) are creative works. We acknowledge this factor and mitigate it through the strongly transformative and non-commercial character of our use.
  • Amount and substantiality used: Audio playback uses only short preview clips provided through the Spotify API (typically 30-second previews), not full recordings. Artwork is displayed at reduced resolution for identification purposes. Lyrics are presented in a synchronized commentary context, not as standalone reproductions.
  • Effect on the market: Musicologia does not substitute for purchasing, streaming, or licensing the original works. On the contrary, the Service is designed to encourage deeper engagement with artists and their music. Users are directed to official streaming platforms for full listening experiences. No content is available for download.

This fair use notice is provided in good faith. It is not legal advice and does not constitute a legal opinion. If you believe any specific use of copyrighted material on this site does not qualify as fair use, please contact us and we will address your concern promptly.

7. Third-Party Services

The Service integrates with third-party platforms including Spotify and GitHub. Your use of those platforms is governed by their respective terms of service. We are not responsible for the content, availability, or practices of third-party services.

8. Analytics

The Service uses Microsoft Clarity for analytics and session replay. By using the Service, you acknowledge and consent to the collection of usage data as described in our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Musicologia and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

11. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective upon posting the updated terms. Your continued use of the Service after changes constitutes acceptance of the revised terms.
